How Police in Kenya Request Data from WhatsApp, Instagram and Facebook
Authorised police and government officials in Kenya can send preservation, emergency and records requests directly to Meta through its law-enforcement portals. For the content of messages, Meta says a mutual legal assistance treaty (MLAT) request or letter rogatory may be required. Kenya has no bilateral mutual legal assistance treaty with the US in force, so where content is needed Meta's guidance points to a letter rogatory (a court's letter of request), sent through diplomatic channels.

How to make the request
- Preserve first. Send a preservation request so the account data is kept while legal process is prepared; Meta preserves records for 90 days pending formal process.

- Attach valid legal process under Kenya’s law for records requests, and identify the account precisely (username, profile URL, phone number with country code).
- Emergencies: where there is imminent harm to a child or a risk of death or serious physical injury, use the portal’s emergency request route.

- Treaties in Force 2026 lists the 1931 US-UK extradition treaty (continued 1965) and a customs mutual assistance agreement (in force Oct 6, 2017) under LAW ENFORCEMENT for Kenya; no criminal MLAT. Source
- CoE chart lists Kenya among non-member States with 'a' and note 4 but no dates, i.e. invited to accede; note 4: 'Since 2013 the decision to invite a non-member State to accede to the treaty is valid five years as from its adoption.' Kenya is not yet a Party. Source
