Emergency requests

Law enforcement submits the Emergency Disclosure Request Form (Annex 1 of the guidelines page); imo may voluntarily disclose at its discretion and responds case by case.

What Imo says about legal process

  • Legal process. US agencies must follow US law; depending on the data sought a valid subpoena, court order or search warrant is required.
  • Requests from other countries. Non-US agencies must typically use the MLAT or letters rogatory processes; imo may at its discretion provide limited non-content information.
  • Preservation. US: preserved under 18 U.S.C. 2703(f) for 90 days, extendable another 90 days on a formal extension request. Non-US: at imo's discretion up to 90 days while MLAT/letters rogatory proceeds, one 90-day extension. Requests on letterhead, non-editable format, signed, with official return email.
  • Notifying the user. imo's policy is to notify users of requests for their information before disclosure, with listed exceptions.
