What Giottus says about legal process

  • Legal process. AML Policy clause 19.2: a request must be in writing, come from an officer competent to make it, identify the legal provision relied on, state the purpose, and identify the account or transaction with enough particularity to act; a request that does not meet these requirements is not actioned and Giottus tells the officer what is missing. Terms clause 13.3.1: Giottus may place a hold on a balance on a request or direction received through the NCRP or the CFCFRMS (operated by I4C), from a law-enforcement agency under section 106 of the Bharatiya Nagarik Suraksha Sanhita, 2023, under the PMLA, or from a banking partner acting on such a direction. Giottus says its detailed procedure is an internal document that it does not publish.
  • Requests from other countries. No procedure for foreign authorities is published.
  • Preservation. No preservation-request process is published. AML Policy clause 18.2 says records relating to an ongoing investigation or a disclosed transaction are kept until it is confirmed that the case has been closed (no five-year cut-off); transaction records at least five years; customer due diligence and transaction records, including IP addresses with timestamps, five years (CERT-In Directions of 28 April 2022); and ICT system logs 180 days, stored in India. Clause 18.3 says audit trails are preserved tamper-proof.
  • Notifying the user. Terms clause 13.3.3: Giottus will inform the user that a hold has been placed, the amount affected and the general nature of the reason, unless prohibited by law or by the terms of the direction.
