What DoorDash says about legal process
- Legal process. Subpoena for basic subscriber information, order and customer-service records; 18 USC 2703(d) court order for non-content records except GPS/location and message content; search warrant for content and GPS/location. California and Utah state and local agencies must use a warrant for some categories.
- Requests from other countries. Authorities in Australia, Canada and New Zealand use the local-entity guidelines at https://about.doordash.com/en-ca/legal/law-enforcement; authorities in countries where DoorDash does not operate should follow MLAT, letter rogatory or similar process, and DoorDash generally requires a US court order via MLAT/letter rogatory to disclose communications content to non-US authorities.
- Preservation. Under 18 USC 2703(f), DoorDash preserves a one-time snapshot of account records for 90 days and extends once for a further 90 days (180 total) on request; submitted through the Law Enforcement Request Form.
- Notifying the user. DoorDash reserves the right to notify customers, Dashers and merchants of data requests unless notice is barred by the process, a lawful nondisclosure order or other law, or DoorDash decides in its discretion to withhold notice (for example in some emergencies); preservation requests are not notified.
