What Automattic (WordPress.com) says about legal process

  • Legal process. Valid US subpoena for names, phone, email, physical address, PayPal info and timestamped creation IP; specific court order or search warrant for additional IP data or info on a specific post/comment; search warrant for content and user communications.
  • Requests from other countries. Foreign agencies must use the MLAT process; Automattic responds only to US judgments or foreign judgments adopted by a US/California court, and releases no user information without a US subpoena, warrant or order.
  • Preservation. Accepted only from government/law enforcement in a criminal investigation; records preserved 90 days and the agency can request an extension. For non-US agencies, data is preserved while MLAT is pursued, and preservation stops if MLAT is not documented as started within 90 days.
  • Notifying the user. Policy is to notify users and give them a copy of legal requests unless a US court order prohibits notice; users generally have 7 days (or until the response deadline) to challenge, and nothing is delivered while a challenge is pending.
