How Police Request Data from Airbnb

Police and government officials send lawful requests to Airbnb through its law-enforcement portal or its legal-process email. The details below are taken from Airbnb's own published guidelines.

Ministry of Cyber Affairs is not Airbnb and cannot create or reset portal accounts, pass on requests or release data. Contact Airbnb directly. Is this your company? Request a correction.

What Airbnb says about legal process

  • Legal process. US: basic subscriber records need a court-issued subpoena (18 USC 2703(c)(2)), other non-content records a 2703(d) court order, message content a search warrant; requests should be typed PDF on letterhead, signed and stamped, and not overly broad.
  • Requests from other countries. Non-US officials use the Guidelines for International Law Enforcement and direct requests to the Airbnb entity that is data controller for the member's jurisdiction; Airbnb may require MLAT or another cross-border process.
  • Preservation. Airbnb may preserve records pending legal process as a one-time snapshot of the account at receipt, not ongoing monitoring, and may reject preservation requests for any reason.
  • Notifying the user. Airbnb generally notifies affected members of valid requests unless law or a court order prohibits it or it judges notice futile or risky; officials can indicate in the portal that notice should not be given.
